Qitzur Shulchan Arukh – 66:2
[The investor] may [meaning: it is permitted and legally binding] to make the condition that the recipient would not be believed if he were to say that he lost some of the capital, unless it is stated by two kosher witnesses, or [the condition that] on the [size of the] profit he would not be believed except with [his taking] an oath.
